Please read these Terms and Conditions ("Terms") carefully before using Servercheck ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Servercheck is a website and server monitoring service that provides:

  • HTTP/HTTPS uptime monitoring from multiple locations
  • SSL certificate monitoring
  • Server resource monitoring (CPU, memory, disk, etc.) via an installed agent
  • Alert notifications via email, Telegram, Viber, WhatsApp, and SMS
  • Subscription-based plans with varying limits

2. Acceptance of Terms

By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to these Terms. We reserve the right to modify these Terms at any time without prior notice. Continued use after modifications constitutes acceptance of the updated Terms.

3. Account

  • You must provide accurate and complete registration information.
  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You are solely responsible for all activities that occur under your account.
  • You must be at least 16 years old to use the Service.
  • We reserve the right to suspend or terminate any account at our sole discretion, at any time, for any reason or no reason, with or without notice.

4. Service "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We expressly disclaim all warranties, including but not limited to:

  • Merchantability - the Service may not meet your commercial needs
  • Fitness for a particular purpose - the Service may not be suitable for your specific use case
  • Availability - the Service may be unavailable, interrupted, or discontinued at any time without notice
  • Accuracy - monitoring results, alerts, metrics, SSL status, and any other data may be inaccurate, incomplete, delayed, or missing
  • Reliability - notifications may not be delivered or may be delivered late
  • Security - despite reasonable measures, no system is immune to breaches
  • Data integrity - your data may be lost, corrupted, or deleted

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SERVERCHECK, ITS OWNER, OPERATORS, DEVELOPERS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, business opportunities, or goodwill
  • Damages arising from service interruptions, downtime, or unavailability
  • Damages resulting from inaccurate, delayed, or missed monitoring alerts
  • Damages arising from unauthorized access to your account or data
  • Damages caused by third-party services (Stripe, Twilio, Telegram, Viber, Google, or any other)
  • Any other damages of any kind

arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Your sole remedy for dissatisfaction with the Service is to stop using it.

If, notwithstanding the above, liability is imposed on us, our total aggregate liability shall not exceed the amount you paid for the Service in the one (1) month immediately preceding the event giving rise to the claim, or $10 USD, whichever is less.

6. No Guarantee of Monitoring

  • We do not guarantee that monitoring checks will be performed at exact intervals or that all checks will succeed.
  • We do not guarantee that you will be notified of downtime, SSL issues, or server problems in a timely manner, or at all.
  • We do not guarantee the accuracy of any monitoring data, response times, status codes, SSL certificate information, or server metrics displayed by the Service.
  • You should not rely on the Service as your sole monitoring solution. We strongly recommend using additional independent monitoring tools.

7. Third-Party Services

The Service integrates with third-party providers (Stripe, Google, Twilio, Telegram, Viber). We are not responsible for:

  • The availability, accuracy, or performance of these third-party services
  • Any data processing performed by third-party services
  • Any charges imposed by third-party services
  • Any changes to third-party APIs or terms that affect the Service

Your use of third-party services is governed by their respective terms and policies.

8. Payments and Subscriptions

  • Paid plans are billed through Stripe. By subscribing, you also agree to Stripe's Terms of Service.
  • Subscription fees are non-refundable unless required by applicable law.
  • We may change pricing at any time. Price changes will apply to subsequent billing cycles.
  • We may downgrade, suspend, or terminate your subscription and access if payment fails or is disputed.
  • Free tier features and limits may change at any time without notice.

9. Server Agent

  • By installing our server monitoring agent on your servers, you consent to the collection and transmission of server metrics to our Service.
  • Before installation, you are responsible for reviewing the agent's source code and satisfying yourself that it contains no malicious code, undisclosed functionality, or behavior beyond its stated purpose (collecting and transmitting server metrics). By proceeding with installation, you confirm that you have had the opportunity to perform this review and accept the agent in its current form.
  • You are solely responsible for installing, configuring, maintaining, and removing the agent on your servers.
  • We are not responsible for any impact the agent may have on your server performance, stability, or security.
  • We are not responsible for any unauthorized modifications, tampering, or compromise of the agent after distribution, whether by third parties or otherwise. You are responsible for verifying the integrity of the agent software you install.
  • The agent communicates with our API over the network. You are responsible for ensuring this is permitted within your infrastructure and compliant with any applicable regulations.

10. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes
  • Not use the Service to monitor resources you do not own or have permission to monitor
  • Not attempt to disrupt, overload, or abuse the Service
  • Not circumvent any limitations or restrictions of the Service
  • Not reverse-engineer, decompile, or disassemble any part of the Service
  • Comply with all applicable laws and regulations

11. Intellectual Property

All rights, title, and interest in the Service (code, design, trademarks, content) remain with the owner. These Terms do not grant you any intellectual property rights in the Service.

12. Termination

  • You may stop using the Service and delete your account at any time.
  • We may suspend or terminate your access at any time, for any reason, with or without notice, without liability to you.
  • Upon termination, your right to use the Service ceases immediately. We are not obligated to retain your data after termination.

13. Indemnification

You agree to indemnify, defend, and hold harmless Servercheck, its owner, developers, operators, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Any data or content you transmit through the Service

14. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: natural disasters, power outages, internet outages, government actions, pandemics, third-party service failures, cyberattacks, or any other force majeure events.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Servercheck regarding the use of the Service.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction where the Service operator resides, without regard to conflict of law principles.
